National Assembly of the Republic of Srpska Adopted Foreign Investment Law


​​​During the third continuation of its 23rd regular session held on 22 February 2018, the National Assembly of the Republic of Srpska adopted the Law on Foreign Investment. This law governs the rights, obligations and status of foreign investors, forms of foreign investments, bodies competent for approving foreign investment, operation of the Foreign Investors Council of the Republic of Srpska and promotion and attraction of foreign investments in the Republic of Srpska.

Pursuant to this law, investments can be made in any sector, except military industry and public information, where the term ‘public information’ was reduced to its narrower and clearer meaning of ‘media affairs’, and opportunities for investing in this sector were further liberalised. The law creates potential for foreign investors to invest in media affairs in a proportion of up to 49 percent of the capital of a business entity in exceptional cases and if so allowed by the regulations governing this field. In view of the role and importance of local self-government units in attracting foreign investments, including stimulating the existing investors to reinvest, and importance of cooperation between the local and the republic level, the law was amended by new articles about those matters in order to strengthen the cooperation between those two levels. The reasons for adoption of the new law lie in the need to improve the legislation in this field, following the amendments to the Law on Foreign Direct Investment Policy, which also improved and upgraded certain provisions.​
